Dividing property in a divorce requires a multi-step process. First, you have to determine if the property is marital or non-marital property. This can be a complex process. Property obtained before the marriage it is generally non-marital. Property obtained during the marriage is generally marital. There are exceptions, however. Gifts and inheritances obtained during the marriage are usually non-marital property. To add to the confusion, in some circumstances non-marital property becomes marital property. In any event, once the marital property is identified it must be divided. In Illinois, marital property is not divided equally (50/50) but equitably. The judge will consider a variety of factors and divide the property based on what is most fair.
